Terms of Use - Organizations
1. Introduction
Welcome to the Apuama platform ("Platform"), operated by APUAMA TECNOLOGIA LTDA, registered under CNPJ number 55.038.380/0001-45 ("Apuama", "we", "our"). These Terms of Use ("Terms") govern the use of our platform and its services. By accessing and using Apuama, you agree to the Terms described herein.
If you do not agree with any part of these Terms, it is recommended that you do not use the Platform.
2. Definitions
- User: An individual or legal entity that uses the Platform.
- Organizer: A person or entity that creates and manages events on the Platform.
- Participant: A person who registers to participate in events advertised on the Platform.
- Event: Any activity listed on the Platform by an Organizer.
3. User Registration
To use Apuama’s services, it is necessary to create an account on the Platform by providing truthful and up-to-date information. Each user is responsible for maintaining the confidentiality of their access credentials.
4. Use of the Platform
4.1. Organizers may list both free and paid events. Currently, only organizers legally established in Brazil may list paid events. Organizers from outside Brazil can create events only in the free modality.
4.2. Participants can register for events and purchase tickets, regardless of their location.
4.3. The use of the Platform for illegal, fraudulent activities, or activities that infringe upon the rights of third parties is prohibited.
5. Fees and Payments
Apuama charges fees on ticket sales for paid events and offers different payment schedules depending on the chosen payment method. The details are described in the table below:

Organizers may request the withdrawal of the funds collected once every 20 calendar days, with no possibility of advance payment.
6. Refunds
6.1. Apuama provides tools for Organizers to process chargebacks up to 2 days after the event has ended.
6.2. All refunds are the sole responsibility of the Organizer.
6.3. The platform fee may or may not be refunded, at the Organizer’s discretion. Should they decide to process a full refund, the fee will be deducted from their available balance.
6.4. To process cancellations and refunds, the Organizer must have an available balance in their account on the Platform.
6.5. If the Organizer chooses not to pass on the platform fee when listing the event, this fee will be automatically deducted in the case of a refund. Thus, only the full refund option will be available since the platform fee will not be visible to the user.
6.6. According to the Pix arrangement, there is a maximum period of 90 days after the settlement date to request a refund. After this period, it will no longer be possible to process the refund via Pix.
7. User Responsibilities
7.1. Organizers:
- Ensure the accuracy of the information provided about events.
- Fulfill the promises made to participants.
- Comply with applicable laws.
7.2. Participants:
- Provide correct information when registering for events.
- Follow the guidelines established by the Organizers.
8. Privacy and Data Protection
User data will be collected and used as described in our Privacy Policy, which is an integral part of these Terms.
9. Right to Image
By using the platform and participating in the events listed, users authorize Apuama and the Organizers to use their images, videos, and testimonials for promotional purposes, without any form of compensation. If a user does not agree with the use of their image, they must expressly request the removal of the content through Apuama’s support channels.
10. Responsibility for Events
Apuama is solely an intermediary platform between Organizers and Participants and is not responsible for the organization, logistics, cancellation, or any operational matters of the listed events. Any issues related to the event must be addressed directly with the Organizer.
11. Cancellation of Events and Refunds
Apuama is not responsible for the cancellation of events listed by Organizers. If an event is canceled, the refund policy will be defined by the Organizer, who is solely responsible for addressing participant refund requests.
12. Data Retention
Apuama may retain certain user information even after account deletion for the purposes of fulfilling legal, tax, or regulatory obligations. Such data will be maintained for the period required by applicable law.
13. International Data Transfer
Apuama may transfer user information to servers or service providers located outside Brazil, ensuring that such transfers comply with the applicable data protection regulations.
14. Limitation of Liability
Apuama is not liable for:
- Technical issues that prevent or hinder the use of the Platform.
- Cancellations or changes in events made by the Organizers.
- The conduct of Organizers or Participants during events.
15. Modifications to the Terms
Apuama reserves the right to change these Terms at any time. Changes will take effect immediately upon publication on the Platform. Continued use of Apuama after any modifications constitutes your acceptance of the changes.
16. General Provisions
16.1. If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.
16.2. The failure to exercise any right provided herein does not constitute a waiver.
17. Jurisdiction
These Terms are governed by Brazilian law. The forum of the domicile of Apuama Tecnologia LTDA is elected to resolve any disputes arising from this instrument, with a waiver of any other jurisdiction, however privileged it may be.
