1. Acceptance of the Terms of Use

1.1. By registering on Apuama and enrolling in events available on the platform, you acknowledge that you have read and fully agree with these Terms of Use and our Privacy Policy.

1.2. If you do not agree with any clause of this document, do not proceed with the registration and enrollment.

2. Registration and User Responsibility

2.1. In order to make purchases and enrollments on the platform, you must provide truthful, up-to-date, and complete personal information. The user is responsible for the accuracy of the provided data.

2.2. The user is responsible for maintaining the security of their login and password and should not share them with third parties. Apuama is not liable for unauthorized access resulting from the user’s negligence.

2.3. If the user enrolls third parties in an event, they declare that they have obtained the necessary authorization from those individuals, assuming full responsibility for the provided information.

3. Nature of the Service Provided

3.1. Apuama is a platform that intermediates between event organizers and participants. Apuama is not responsible for the execution of the events, as the organizer is solely responsible for the event’s execution, cancellation, refunds, and other matters related to the event’s organization.

3.2. The responsibility for communicating event information (time, location, regulations, participation rules) rests exclusively with the organizer.

3.3. Apuama is not liable for any changes, postponements, or cancellations made by the organizer, with the organizer being solely responsible for refunding the participant.

4. Payments, Refunds, and Cancellations

4.1. The enrollment fee is determined by the event organizer and may include additional fees for the platform’s intermediation.

4.2. Apuama transfers the enrollment fees directly to the event organizer. Any refund or cancellation request must be made directly with the organizer, in accordance with the rules established in the event regulations.

4.3. In the event of cancellation or postponement of the event, the organizer is solely responsible for refunds, releasing Apuama from any financial obligation.

4.4. In case of any discrepancies between the paid amounts and those disclosed in the event regulations, the amount stated in the regulations will prevail. Apuama and the organizer may make adjustments and issue refunds if necessary.

5. Conditions for Participation in the Event

5.1. The participant declares that they are fit to participate in the event, possessing the appropriate physical and health conditions.

5.2. The participant agrees to follow all the rules stated in the event regulations, including age restrictions, required equipment, and any other conditions provided by the organizer.

5.3. If the event requires the collection of a kit, the participant must follow the instructions and deadlines established by the organizer.

6. Use of Image and Personal Data

6.1. By enrolling in an event through Apuama, the participant authorizes the organizer and its partners to use their image in promotional materials, including social media, websites, and promotional campaigns, without any financial compensation.

6.2. Apuama may share the participant’s data with the organizer and event partners, in compliance with the guidelines of the General Data Protection Law (LGPD).

7. Disclaimer

7.1. Apuama is not responsible for:

• The execution or non-execution of the event;

• The user’s participation in the event;

• Any physical, material, or moral damage that the user may suffer before, during, or after the event;

• Errors or omissions in the information provided by the organizer.

7.2. The participant is fully responsible for any damage caused to third parties, organizers, or the public during their participation in the event.

7.3. Should medical attention be required during the event, it will be provided according to the structure made available by the organizer, who may refer the participant to public health services if necessary.

8. Customer Service and Support

8.2. The platform’s customer service is available Monday to Friday, from 09:00 to 12:00 and from 13:00 to 17:00 (Brasília Time). There is no service on Saturdays, Sundays, or public holidays.

9. Final Provisions

9.1. These Terms of Use may be amended at any time for better alignment with Apuama’s services. Changes will be communicated through the platform.

9.2. Continued use of the platform after updates to the Terms of Use implies acceptance of the new conditions.

9.3. For any disputes or conflicts, the court of the city of [City/State] is elected, with the waiver of any other jurisdiction, however privileged it may be.
